Got in an accident in the right lane, as the other lanes were full?

i had recently got in an accident, i was always in the right lane driving down with no cors ahead of me. the other lanes where packed with cars stopped. as im driving down i was going to pass a t intersection with no stop signs and no lights. as i was passing, from the opposite side a person was making a left turn to enter the small street. i didnt see him and as im about to pass the T intersection he hits me from the side and pushes me in the sidewalk and i hit a pedestrian lightly. i want to know if this was his fault or myfault knowing that the other drivers had stopped for him to make the turn as i kept driving on my lane. please help.
